Who we are

Compass & Creek designs and sells outdoor gear from our base in Auckland, New Zealand.

In these terms, "we", "us" and "our" means Compass & Creek. "You" means the person using this website or placing an order.

Agreeing to these terms

By using this website or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.

These terms should be read alongside our Shipping and Delivery policy, our Returns, Refunds and Warranty policy and our Privacy policy. Those policies form part of these terms.

Using this website

You need to be at least 18 years old, or have permission from a parent or guardian, to place an order.

You agree not to use this site for anything unlawful, not to interfere with how it works, and not to try to access parts of it you are not meant to.

If you create an account, keep your login details to yourself. You are responsible for what happens under your account.

Product information

We do our best to describe our products accurately and keep specifications up to date. Photos, colours and packaging can vary slightly from what arrives, and we sometimes improve a product between production runs.

If a detail on the site matters to your decision, email us before you order and we will confirm it.

Pricing

Prices on the New Zealand site are in New Zealand dollars and include GST. Prices shown in other currencies or regions include any taxes noted at checkout.

We can change prices at any time, but a change will not affect an order we have already accepted.

If a product is listed at an obviously wrong price because of a system or human error, we can cancel the order and refund you in full rather than supply at that price. We will contact you first if that happens.

Discount codes cannot be used together unless we say so, and we can withdraw a code at any time.

Orders

Placing an order is an offer to buy. Your order is accepted when we send you a dispatch confirmation, not when you get the order confirmation email.

We can decline or cancel an order before dispatch. Reasons include a product being out of stock, a pricing or listing error, a payment we cannot verify, a delivery address we cannot ship to, or an order we reasonably believe is for resale without our agreement. If we cancel, we refund you in full.

Payment

Payment is taken at checkout through our payment providers. We do not store your full card details.

If you pay with a buy now pay later provider, your agreement with them is separate from this one and their terms apply on top of ours.

Stock and pre orders

Stock levels shown on the site are our best current view and can change.

Where a product is on pre order, the expected dispatch window is shown on the product page. Those windows are estimates and depend on production and freight. We will email you if a window changes, and you can cancel a pre order for a full refund at any time before dispatch.

Shipping, returns and warranty

Change of mind returns, faulty products, refunds and our 12 month warranty are covered in our Returns, Refunds and Warranty policy.

Using our products safely

Our gear is built for the outdoors, but it still needs to be used the way it is meant to be. Follow the instructions that come with the product.

A few things worth knowing:

Products with a rechargeable lithium ion battery should be charged with the cable supplied, kept out of direct heat, and not charged unattended or while damaged. Do not open the battery housing.

Our shower pumps are made for warm water mixed to hand temperature, not straight hot water off the stove or out of a hot tap. A good rule of thumb is that if the water is too hot to comfortably put your hand in, it is too hot for the pump.

After use in salt water, flush the pump through with fresh water.

Gas powered products must only be used outdoors in a well ventilated space, following the safety instructions supplied with the unit.

Damage caused by not following the instructions is not covered by our warranty.

Reviews and content you send us

If you post a review, send us a photo or video, or tag us on social media, you are giving us permission to use that content on our website, in our marketing and on our own social channels, with credit where it makes sense.

You confirm the content is yours to share and that it does not breach anyone else's rights. We can decline to publish, or remove, content that is offensive, misleading, not about the product, or otherwise not appropriate.

We do not edit or delete reviews just because they are negative.

Our intellectual property

The Compass & Creek name and logo, SaltRinse™, Solar Sac™, our product designs, photography, video and website copy belong to us or are used with permission.

You can share our content for personal, non commercial use. You cannot copy our product listings, images, designs or copy for commercial purposes, or use our brand in a way that suggests we endorse you, without our written permission.

Links to other sites

Our site may link to other websites we do not control. We are not responsible for their content or their terms.

Buying for business purposes

If you are buying our products for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, to that supply. Both parties agree this exclusion is fair and reasonable.

Our 12 month warranty still applies to business purchases.

If you are buying as a consumer, this section does not apply to you and your consumer law rights are not affected.

Our liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Australian Consumer Law where it applies, or any other law that cannot be excluded.

Beyond those rights, and to the extent the law allows, we are not liable for indirect or consequential loss, including loss of profit, loss of use, or loss arising from a delayed delivery. Where we are liable, our total liability is limited to the amount you paid for the product concerned.

We do our best to keep this website available and accurate, but we do not guarantee it will always be available or free of errors.

Things outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including courier disruption, severe weather, natural disasters, supply chain or manufacturing delays, strikes, or changes in law. If something like that happens we will let you know and work out the best option with you.

Privacy

How we collect and use your information is set out in our Privacy policy.

Changes to these terms

We can update these terms from time to time. The version on this page at the time you place an order is the one that applies to that order.

Governing law

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute.

If something has gone wrong, please email us first. We would much rather sort it out directly.
